Background: GAO reviewed the appropriateness of a termination of a 1997 request by the Indian Health Services (IHS) for proposals to provide computed tomographic scanning services for the Blackfeet and Crow Service Units in Montana. GAO found no indication that IHS negotiated in bad faith. GAO’s Office of Special Investigations had looked into the case in December 1998. GAO determined that the case was not within the scope of ongoing work and referred the case to the Department of Health and Human Services Office of Inspector General (OIG). A June 1999 report by the OIG concluded that the allegations were unwarranted.

Background: A firm protested an Indian preference provision in a Department of Health and Human Services (HHS) solicitation, contending that there was no legal basis for such a preference. Although HHS argued that the provision reasonably furthered the purposes of the Native American Programs Act, GAO found nothing in the act that permitted the provision to be included in the solicitation. Further, the solicitation violated the requirement for maximum competition in Federal procurements. GAO recommended that HHS regulations be revised to eliminate the preference and that the solicitation be amended to provide for discussions with all offerers in the competitive range. Water sampling and laboratory analysis practices used on the reservation were also reviewed. Because there is no overall plan or supervision by EPA, confusion and misunderstandings have resulted over the roles and responsibilities of water suppliers and organizations in carrying out the drinking water program.
